Terms of Service

1. Scope

These Terms of Service govern your use of Plianta Fieldnotes ("the Service"), a photo documentation application for industrial inspections provided by Plianta ("we", "us").

By creating an account or using the Service, you agree to these terms.

2. Account Registration

• You must provide a valid email address to create an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 16 years old to use the Service
• One person may not maintain more than one account

3. Service Tiers

Plianta Fieldnotes offers the following tiers:

• Free: Core features including photo capture, categorization, session management, and PowerPoint export
• Pro: All Free features plus AI-powered photo analysis and additional capabilities

We reserve the right to modify features included in each tier with reasonable notice.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Upload content that violates third-party rights
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the Service
• Use automated tools to access the Service without permission

5. Your Content

You retain ownership of all photos, notes, and other content you create using the Service. By uploading content, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

When using the AI analysis feature, your photos are processed by Anthropic's Claude API. You consent to this processing when you enable the AI feature. See our Privacy Policy for details.

6. Team Collaboration

When you create or join inspection sessions, other session members can view and interact with shared content within that session. Session administrators can manage members and session settings.

7. Availability and Support

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The offline-first architecture ensures you can continue working without an internet connection.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the Service in the past 12 months
• We are not responsible for the accuracy of AI-generated analysis results

9. Account Termination

You may delete your account at any time from within the app. See account deletion instructions.

We may suspend or terminate accounts that violate these terms, with notice where possible.

10. Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. The courts of Germany shall have exclusive jurisdiction over any disputes arising from or relating to these terms.
